Overtime Ruling from the Department of Labor
The Department of Labor (DOL) asked that their challenge to judgment that stopped the new overtime regulation from taking effect be halted on November 6th. This means they are no longer pursuing legal means to force the 2016 overtime rule into effect. This change in position makes it very unlikely that the rule will ever take effect.

In the summary judgment that prevented the new overtime rule from going into effect, the court held that the DOL exceeded its authority by setting a minimum salary level so high—$47,476 per year—that it would render more than 4 million people nonexempt who are currently performing duties consistent with exempt status.

“This means employees making $23,600 per week who meet the duties criteria can continue to be treated as exempt from overtime,” said Venette Davis, H&R Block franchise owner in Beloit. “This does not eliminate the ability of the DOL to raise the salary threshold for exempt employees in the future; however, it is unclear what size of increase is considered lawful for the DOL. Until that is clarified, there will probably be no change.”
