Changes Pending for Salaried Employees

Overtime Rule expected to be costly

News release by H & R Block

The U.S. Department of Labor (DOL) is preparing to implement a regulation that will increase the threshold for an employee to be categorized as exempt from overtime.  Currently, certain employees are exempt from overtime.  The minimum salary threshold is $23,660.  The new regulations will raise the minimum salary threshold to $50,440.

According to Venette Davis at H&R Block, “The new ruling will require employers to either increase the salary level to $50,440 to still be exempt from overtime or reclassify employees as hourly and pay overtime.  We are trying to get the word out on this potential change so that employers have time to plan how they will deal with the new ruling.”

The DOL is still considering where to set the new salary threshold.  Some sources have reported they may drop the minimum salary to $47,000 because of complaints by business.  Employers are expected to have 60 days to implement the change after it is approved which means the ruling will likely be implemented in 2016.

The House of Representatives has a bill on the floor to block the implementation of the ruling.  The bill, H.R.4773 – Protecting Workplace Advancement and Opportunity Act, is currently under discussion.  It is not too late to provide feedback on the House bill to try and stop the DOL regulation from being enacted.

The DOL is expected to change the definition of duties to be classified as an exempt employee. They have also have limited groups of employees which are excluded from the new salary threshold rules.  For more information or a review of the impact on your business or farm employees, contact H&R Block Beloit at 738-5801.
